This Privacy Policy explains how we collect, use, share, retain, and protect information when you visit bertondirect.com (the "Site"), apply for a trade account, or purchase products from us.
Berton Direct sells only to businesses, healthcare facilities, and licensed practitioners. It is not intended for personal or household purchases.
We collect only the information we need to verify eligibility, fulfill orders, and meet our legal obligations as a healthcare product distributor.
Business and account information. Business legal name and any trade name, facility or practice type, business, billing, and shipping addresses, the name, title, work email, and work phone of the account holder and authorized users, federal tax identification number, and sales-tax exemption or resale certificates.
Credential information. National Provider Identifier (NPI), where applicable. State professional, facility, or pharmacy licence and permit numbers, with their issuing authority and expiration dates. Copies of licences or permits you upload.
Identity verification information. When required to confirm the identity of an account holder, we may ask for a government-issued photo identification. See Section 5 for how long we keep it.
Order and transaction information. Products ordered, quantities, lot and expiration information, order and delivery dates, invoices, returns, and account credits.
Payment information. Card payments are processed through a hosted checkout provided by our payment processor, Stripe. Your full card number is entered directly with Stripe and is never received or stored by Berton Direct. We receive only limited details such as card type, the last four digits, and payment status.
Communications. Messages, support requests, and other correspondence you send us.
Website and device information. When you use the Site, we and our analytics provider collect information such as pages viewed, referring pages or referral codes, browser and device type, and approximate location derived from IP address. We use Google Analytics only after you consent through our cookie banner. See Section 8.
We use the information we collect to:
To comply with federal and Florida laws governing the distribution of healthcare products, we verify the licences, permits, and identifiers you provide against government and publicly available registries. These include the National Plan and Provider Enumeration System (NPI Registry) and state licensing and permit databases.
We verify:
Account approval and continued access to prescription products depend on successful verification. We may place an account on hold, or decline or cancel an order, if a credential has lapsed, is restricted, or cannot be verified. We keep a dated record of each verification we perform.
We do not sell personal information, and we do not share it with third parties for their own marketing. We share information only as follows:
| Information | Retention period |
|---|---|
| Account records, licence and permit copies, credential numbers, and verification results | For as long as the account is active, and for six (6) years after the account's last transaction |
| Order, invoice, shipment, return, and disposition records | Six (6) years from the date of the transaction or disposition |
| Government-issued identification documents | Deleted once identity verification is complete. We keep the document's expiration date and a record that verification took place, and we request a current document when renewal approaches. |
| Applications that are not approved, and incomplete or abandoned applications | Deleted twelve (12) months after the application was declined or last updated |
| Marketing contact preferences | Until you opt out, after which we keep only what is needed to honor the opt-out |
| Website analytics data | Fourteen (14) months, after which Google Analytics automatically deletes user-level data |
The six-year period reflects the recordkeeping requirements of the Florida Drug and Cosmetic Act and federal drug supply chain laws. When a retention period ends, we securely delete or destroy the information.
Some information you give us, such as government-issued identification and financial account details, is sensitive. We protect it as follows:
No method of storage or transmission is completely secure. If a security incident affects your personal information, we will notify you as required by Florida law, including section 501.171, Florida Statutes.
Berton Direct does not collect patient health information. Orders are placed by, and shipped to, verified businesses, facilities, and practitioners. Please do not include patient names or other patient information in orders, notes, or messages to us.
The Site uses cookies that are strictly necessary for login, security, and checkout. With your consent, we also use Google Analytics to understand how the Site is used, including how visitors arrive through referral links. You can accept or decline analytics cookies through our cookie banner and change your choice at any time using the "Cookie Settings" link in the footer of every page. Declining analytics cookies does not affect your ability to use the Site or place orders.
The Site is intended for business use and is not directed to anyone under 18. We do not knowingly collect information from minors.
We may update this Policy from time to time. We will post the updated version with a new effective date and, for material changes, notify account holders by email.
